These Terms of Service describe the conditions for using the ekua.io website.
Scope
These Terms of Service ('Terms') govern solely the use of the ekua.io website (the 'Site'), operated by Ekua ('Ekua', 'we'). By browsing or using the Site, you agree to these Terms.
The Ekua service (its AI agents, WhatsApp integration, and associated data processing) is governed by separate written agreements entered into directly with each enterprise client. These Terms do not govern or replace those agreements; they are strictly limited to use of the Site as an informational and marketing property.
Acceptable use
You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:
- Attempt to gain unauthorized access to the Site or its underlying systems
- Interfere with the Site's normal operation through aggressive automated scraping, denial-of-service attacks, or similar means
- Use the Site to distribute malicious code, spam, or unlawful content
- Impersonate another person or entity while interacting with the Site
Intellectual property
All content on the Site (text, design, graphics, logos, branding, and code) is owned by Ekua or its licensors and is protected by applicable intellectual property laws.
These Terms do not grant you any license to reproduce, distribute, modify, or create derivative works from the Site's content, except with Ekua's prior written authorization.
No warranty; no reliance on marketing content
Content on the Site, including illustrative demonstrations, simulated conversation mockups, and feature descriptions, is provided for informational and marketing purposes only. No demonstration, mockup, or description published on the Site constitutes a contractual promise or a guarantee about the actual performance of the Ekua service.
The Site is provided 'as is,' without warranties of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, Ekua will not be liable for indirect, incidental, special, or consequential damages arising from use of, or inability to use, the Site.
Nothing in these Terms limits Ekua's liability for willful misconduct or gross negligence where such limitation is not permitted by law.
Governing law
These Terms are governed by the law applicable under the relevant client agreement or, absent one, by the law that applies under standard conflict-of-laws principles.
Changes to these terms
Ekua may update these Terms from time to time. The 'Last updated' date at the top of this page reflects the version in effect. Continued use of the Site after an update constitutes acceptance of the revised Terms.
